Legal information

There is an association in conformance with Art. 60 et seq. of the Swiss Civil Code based in Bern named "Pen-sionClub”.

The association represents the common interests of its members relating to pension provision and insurance issues to policy-makers, authorities and other institutions. It promotes the economic interests of its members and provides information and further training to its members, especially with regard to developments, oppor-tunities and risks in the area of pension provision and insurance. The association is a self-help, non-profit and non-denominational organization.

The PensionClub (hereinafter “PensionClub”, “we” or ”us”) is subject to, inter alia, the following contract conditions, legal notices and data protection provisions:

1. Terms and conditions of use
1.1General
By accessing this PensionClub website and its pages as well as the products, services, information, data, tools and documents on the website (hereinafter ”website”) you declare that you have understood and are in agreement with the following terms and conditions of use.

PensionClub reserves the right to amend or remove these terms and conditions of use at any time and without providing notification. It is therefore advisable to regularly read the latest version of these terms and conditions of use. The terms and conditions of use in force at the time of accessing the website are applicable.

1.2 Access restrictions
The website is designed for companies and persons who
- are based or reside in Switzerland or
- who are eligible to set up a 2nd and/or 3rd pillar pension solution under Swiss law and who are capa-ble under the applicable legal regime of using PensionClub’s free and chargeable services (hereinafter “services”).

1.3 Ownership and use of the website, copyright, brands and logos
The website and the brands and logos used on the website are, unless otherwise stated, the exclusive property of PensionClub or the relevant copyright holder. The entire content of the website is protected by copyright. Saving or printing individual pages and/or parts of this website is permitted, provided neither the copyright notices nor other legally protected designations are removed. The storage or re-production by other means of software or other data on the website indicate acceptance of the terms and conditions of use. All ownership and licensing rights remain with PensionClub. The (entire or par-tial) reproduction, transmission (electronic or by other means), modification, linking or use of the web-site for public or commercial purposes is prohibited without the prior written agreement of PensionClub.

1.4 No advice
The information on the website is not a decision-making aid for business, legal, taxation or other advi-sory issues. It was not created to provide, based solely on the information contained therein, a decision-making tool for investment or other decisions. Expert advice is recommended.

1.5 No guarantee and no liability
To the extent permitted by law, PensionClub declines any liability for losses or damage of whatever type – whether for direct, indirect or consequential damage – which result from the use of or accessing the website or links to websites of third parties. Liability for persons providing support is also expressly excluded.

Furthermore, PensionClub declines any liability for manipulations of the internet user’s EDP system by unauthorized persons. PensionClub hereby makes express reference to the threat of virus transmission, other harmful components and the possibility of targeted hacking attacks. The use of current browser versions and the installation of updated anti-virus software are recommended to combat viruses. Open-ing e-mails of unknown origin or unexpected attachments to an e-mail is to be avoided as a rule.

The information on the website is prepared "as seen" and "as available". PensionClub offers no guaran-tee that access to the website will be free of technical error or interruption, that issues will be resolved or that no technical problems of any other type will occur during use.

The published information and details are prepared by PensionClub exclusively for own use as well as for information purposes; it is subject to change or removal at any time and without prior notification. Alt-hough PensionClub applies the customary due diligence to ensure the information on the website is correct, reliable and complete at time of publication, PensionClub neither provides any assurance nor offers any guarantees (whether explicit or tacit) for the accuracy, reliability, completeness and actuality of the information published on the website. You hereby declare that you are neither misusing the services nor assisting others to do so. You are solely responsible for the use of the services. PensionClub declines all liability for the unlawful, improper or fraudulent use of the services.

1.9 Severability clause
The ineffectiveness or partial ineffectiveness of individual provisions of these terms and conditions of use do not impact the effectiveness of the other provisions or the terms and conditions of use as a whole.

1.10 Applicable law and jurisdiction
Should a legal relationship arise from use of the website, it is subject to the substantive law of Switzer-land to the exclusion of any conflict of laws. The exclusive place of jurisdiction for any disputes connect-ed to the use of the website is the competent court in Bern.
